On the 2nd June 2026, in a seismic legal judgment in the ‘AGNI’ case, the Supreme Court overturned its own decision in the ‘Cheshire West’ case on the meaning of deprivation of liberty.

The judgment has far-reaching implications for local authorities, health and social care providers and practitioners, and replaces the ‘acid test’ laid down in Cheshire West. The judgment means many fewer people will be considered deprived of their liberty. However, it also means practitioners, providers and local authorities will likely have to make more complex judgments to determine if a person is deprived of their liberty.

In this one-day legal masterclass, you will hear directly from four experienced lawyers, including two who were involved in the AGNI case. Sessions will provide you with a clear understanding of the AGNI judgment, how it affects your practice and how it affects under-18s.

There are also sessions focusing more broadly on the legal complexities around mental capacity, including the role of insight and executive functioning, and on the significant challenge of hoarding disorder.
